FTM Pro, Inc. and all of its parents, subsidiaries and affiliates (“Company,” “us,” or “we”) respect the privacy of the users of the ftmpro.com, app.ftmpro.com, connect.ftmpro.com, associate.ftmpro.com, myftmpro.com, ftmassociate.com websites, FTMfinancialservices.com, FTMAA.com and the FTM Pro mobile app (hereinafter “Websites” or “Sites”), and those individuals with whom we conduct business offline. This privacy policy (“privacy policy” or “policy”) tells you (“You”) what information we collect from you, how we might use it, how you can review or change the personal information you provided to us, how we may change this policy, and the steps we take to ensure that your personal information is protected.

In the 12 months preceding the last updated date of this privacy policy, we have not “sold” personal information, including personal information of minors under the age of 18. “Sold” means the disclosure of personal information to a third-party for monetary or other valuable consideration.

Profile Information
If you have created an account, you can update your profile information by logging in and editing your profile. If you need to change the name or social security number associated with your account, please login and submit an E-Form request for “Associate Information Change”.
Email Subscriptions. You can always unsubscribe from promotional emails via the link provided in the emails. Even if you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us.
Account Deletion
If you would like to delete your registered account, please log in and submit a “Contracting Request” marked “other” through our E-form system with the text “Terminate My FTM Pro App Account” in the notes. Alternatively, you may email legal@ftmpro.com with the subject line of: “Terminate My FTM Pro App Account”.
If you choose to delete your account, we will delete it for you, but may retain certain information required to process commission payments, resolve disputes, troubleshoot problems, analyze usage of the Websites, assist with any investigations, prevent fraud, enforce our Terms and Conditions, enforce our FTM PRO App Terms of Use, or take other actions as required or permitted by law and/or regulations.
- CONSENT TO TRANSFER
Our computer systems are currently based in the United States, so your personal data will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. If you create an account with us as a visitor from outside the United States, by using the Websites, you agree to this Privacy policy and you consent to the transfer of all such information to the United States, which may not offer a level of protection equivalent to that required in certain other countries, and to the processing of that information as described in this Privacy policy.

Your Right to Request We Delete Your Personal Information
You have the right to request that we delete any of your personal information that we collected from you and retained unless retaining the information is necessary for us or our service provider(s) to:

- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, California residents may submit a verifiable consumer request to us by either:
Logging into your FTM PRO App account and submitting a “CCPA Request” through our E-Form system or calling us at our number: 1-832-800-9955
Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password-protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Pursuant to the CCPA we will attempt to respond to a verifiable consumer request within forty five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to the email address on file with account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Pursuant to the CCPA any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will not discriminate against you, deny you goods or services, charge you a different price, or provide you with a lesser quality of goods or services if you exercise any of your CCPA rights.
- NEVADA RESIDENTS: NEVADA PRIVACY RIGHTS
Nevada law (SB 220) requires website operators to provide a way for Nevada consumers to opt out of the sale of certain information that the website operator may collect about them. We do not sell your personal information to third parties as defined in Nevada law, and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law.
